Crypto Regulation Around the World: What to Check

·

3 min. read

Crypto rules depend on the asset, service and jurisdiction. Owning a token, operating an exchange, offering a financial product and advertising a service can fall under different requirements. This overview separates those questions rather than assigning each country a single “legal” or “banned” label.

United States

US oversight involves securities, commodities, banking and other rules. The relevant question is not simply whether something uses a blockchain, but what rights the asset creates and how a transaction or service is structured.

The SEC’s March 2026 interpretation distinguishes cryptoassets from investment-contract arrangements involving them. Earlier enforcement cases and ETF approvals should be read in their specific context, rather than as a universal classification or government endorsement of crypto.

China

Mainland China’s 2021 notice classified specified virtual-currency business activities as illegal financial activities. Its scope should be read separately from rules elsewhere, including Hong Kong, rather than treating every form of possession or use as the same legal question.

Canada

In Canada, securities registration and FINTRAC money-services obligations serve different purposes. Dealing in virtual currency can trigger MSB requirements, but not every investment business is automatically an MSB. Registration, product eligibility and tax treatment need separate checks.

United Kingdom

The UK distinguishes retail crypto derivatives from eligible crypto exchange-traded notes. The FCA opened retail access to qualifying cETNs from October 2025 while retaining its retail crypto-derivatives restriction. Product eligibility, financial-promotion rules and consumer protections need to be checked individually.

Japan

Japan requires registration for cryptoasset exchange services. The FSA’s register is a way to check a provider; inclusion does not endorse the assets it handles or guarantee their value.

Australia

Australia’s financial-services and AML requirements depend on the activity and product. The Digital Assets Framework Act received Royal Assent in April 2026 with commencement scheduled for April 2027. That timetable is distinct from existing licensing obligations and ASIC’s earlier guidance.

Singapore

Singapore regulates relevant digital-payment-token services through MAS licensing requirements. The applicable regime depends on the token and where customers are served. A licence for one activity does not authorize every product, and licensing should not be confused with tax treatment.

South Korea

South Korea’s rules cover virtual-asset service providers and user protection. Before using a service, check its status with the relevant Korean authorities and the restrictions for that particular product.

India

India has specific reporting obligations for covered virtual-digital-asset service providers. Tax and withholding rules are separate questions: paying a tax does not by itself establish that every related service is authorized.

Brazil

Brazil’s central bank regulates and supervises covered virtual-asset service providers. The service-provider framework and later implementing rules do not make crypto equivalent to sovereign currency or establish universal access to every product.

European Union

MiCA establishes EU requirements for covered cryptoassets and services, with exclusions and distinctions between product types. The maximum national CASP transition period ended on July 1, 2026. A provider’s authorization and the scope of its permitted services should be checked in the relevant register.

Use current, activity-specific information

Check the regulator’s current register, the product documents and the applicable effective dates. Distinguish a proposal from an enacted rule, and an enacted rule from one already in force. This overview is not a country-by-country tax or legal opinion.
